Depending on the nature of the proceedings, cases may take from one to two and a half years. In rare cases even more.

Individuals in removal proceedings, or with active cases in immigration Court cannot leave the United Sates during the pendency of removal proceedings. If a person leaves the United States when removal proceedings are pending, the Immigration Judge may find all applications abandoned and issue an order of removal. Leaving the Untied Sates during removal proceedings can also lead to adverse immigration consequences, like being barred from reentering the United Sates for several years.

Several factors determine the chances of success, like the type of case, applicable case law, criminal history, and available defenses. What we do to ensure a high likelihood of success is ensure that the client qualifies for relief before deciding to take on the case. Every case has the potential to being resolved, but some more difficult cases will carry more risk, depending on how the judge, or immigration officer interprets the particular facts of the case. Normally, cases with a lengthy criminal history can pose a greater risk to applicants, so they require a higher level of attention and care.

Prices vary depending on type of case, normally the attorney will explain to clients the fees associated with representation and will ensure that clients thoroughly understand pricing depending on the available defenses, applications, and nature and purpose of their immigration proceedings.

Sometimes. In most cases, to file a petition for a family member the petitioner must have legal status in the United States, like residence or citizenship. But in other cases, asylees with no legal status may petition for their spouses and children depending on several factors, like type of relationship, time of entry into the United States, age, length of marriage, among others.

This is one of the most common questions we receive. The short answer is “it depends.” There are several factors that may allow an applicant to qualify to adjust status regardless of manner of entry. We have solved several cases where individuals enter the U.S. unlawfully, and are able to adjust. Some of the factors to consider are date of entry, manner of entry, military service, pending family petitions, prior immigration relief, etc.

Absolutely, but there is always hope. While some criminal convictions disqualify an immigrant from relief, there are some that do not. That is why it is so important to have your case assessed by an experienced immigration attorney, or several.

Lawful Permanent Resident status is definitely possible for Cuban nationals who have entered the United States with form I-220-A. Our office has secured many of these residences, the fastest processing times have been from three to six months. Others take approximately a year and a half.
